Privacy Policy – Recruitment
1. General
This privacy policy (“Privacy Policy”) describes what personal data of the data subject (“you”, “applicant” or “data subject”) Cactos Oy (3249847–2), Cactos Fleet Management Finland Oy (3296517–3), Cactos Energia Oy (3544975–6), Cactos Fund Management Oy (3544966–8), Cactos B.V (89387228–000055184006) and Cactos Netherlands B.V (89394534–000055190715) (together “Cactos”, “we” or “the controller”) processes as the controller, and how and for what purposes such personal data are processed. This Privacy Policy also describes how personal data is transferred to third parties and how you can exercise your rights related to the processing of personal data.
This Privacy Policy applies to the processing of personal data collected in connection with Cactos' recruitment processes. Cactos complies with applicable data protection legislation in all processing of personal data, including the General Data Protection Regulation (EU 2016/679) and the Finnish Data Protection Act (1050/2018). Terms related to data protection that are not defined in this Privacy Policy shall be interpreted in accordance with data protection legislation.

3. Groups of Data Subjects
The personal data processing described in this Privacy Policy concerns persons who have applied for a job at Cactos (job applicants) or who visit Cactos Career Site or other recruiting platform.
4. Personal Data Processed, Purpose and Legal Basis of Processing
Cactos processes, as the controller, the applicant's data, which is collected to enable and carry out Cactos' recruitment process. In this Privacy Policy, recruitment process means the process in which Cactos recruits new employees, including the review of job applications, interviews, possible aptitude assessments and communication regarding the recruitment.
Below is described in more detail what personal data Cactos may process as part of the recruitment process as well as the legal basis of the processing:
Identification details (name, date of birth, address, phone number, email)
Information related to competence (information on skills, education, work experience and qualifications)
Possible referees indicated by the applicant and their contact details
Other possible information provided by the applicant in the job application, CV, job interview and possible aptitude assessment.
The processing of personal data is based on Cactos' legitimate interest in processing the applicant's job application and carrying out the recruitment process, as well as on the data subject's explicit consent insofar as this has been specified in more detail in connection with the consent. The personal data processing carried out by Cactos described in this Privacy Policy is not subject to automated decision-making.
Insofar as the processing of personal data is based on legitimate interest, the applicant has, as the data subject, the right to obtain additional information about the applicable legitimate interest through the contact details presented in section 2 of the Privacy Policy. The applicant is obliged to obtain the necessary consents for the storage and processing of the personal data of their possible referees in accordance with this Privacy Policy.
In addition, when using Cactos' website, the following personal data is processed by Cactos:
Cookie data such as browser type, operating system, device model, IP address, location data, connection time, and duration (the cookie banner of the website provides more detailed information of the processing of cookie data);
Statistical data on, for example, the number of visitors to a website or application software, usage patterns, location, or other behavior on the website or in the application software; and
Information collected through the website, such as name, email, phone number, company, and any other data you fill in on the contact form.
When you visit Cactos' website, Cactos processes the above-specified personal data to provide, maintain, and develop the website, to compile website usage statistics, and to process contact requests submitted through the website. The processing of personal data for the purposes specified above is based on Cactos's legitimate interest and otherwise on the data subject's separate explicit consent. From Cactos's website's cookie banner you can manage consents concerning the use of cookies as well as get more detailed information about the cookies used on the website and about the personal data collected by them.
5. Regular Data Sources
Cactos primarily collects personal data from the data subject themself in connection with the recruitment process. Cactos can receive personal data also from third parties in relation to the data subject, such as from recruitment consultants participating in the recruitment process and, in part, from sources indicated by the applicant, such as the applicant's referees.
6. Processors and Other Recipients of Data
Personal data may be disclosed to service providers, recruitment consultants and recruitment companies in a contractual relationship with the controller to the extent that the consultant or company in question participates in the applicant's recruitment process in order to implement the purpose of the processing.
In addition, Cactos may disclose personal data to parties acting as the technical implementer of the recruitment or as other recruitment service providers, and thus as processors of the personal data collected by Cactos, with whom Cactos has concluded the appropriate agreements on the processing of personal data required by applicable data protection legislation.
In exceptional circumstances, Cactos may also have to disclose personal data to other third parties if required by applicable law, regulation, or another order of an authority. Cactos may also transfer personal data within its group companies, as well as in connection with a possible merger, acquisition, or business transfer in which Cactos or its business or part thereof is sold to the data recipient.
7. Transfers of Personal Data Outside the EU or EEA
Cactos transfers personal data outside the EU or EEA, if it is necessary for the implementation of the purposes of personal data processing or for the technical maintenance of the data. If personal data are processed outside the EU or EEA, Cactos takes care that the conditions for data transfer set in the EU's Data Protection Regulation are fulfilled, and that the collected data are transferred only to such third countries or parties whose level of data protection the European Commission has found sufficient (for example, under the EU-U.S. Data Privacy Framework), or that the recipient of the personal data has committed to the European Commission's standard contractual clauses concerning the processing of personal data, and, if necessary, has taken care of sufficient technical additional protective measures.
If the international data transfer is based on the Commission's standard contractual clauses, you have, as the data subject, the right to obtain the applied standard contractual clauses for your review by contacting the address mentioned in section 2 of this Privacy Policy.
8. Data Retention Policies
Cactos stores the personal data it processes only as long as they are necessary for those purposes for which the personal data are processed.
The applicant's personal data is stored for the duration of the recruitment process and for one (1) year after the end of the recruitment process, unless there is a basis for storing the data longer, arising for example from law or from processing a legal claim. Cactos evaluates the necessity of data retention regularly, taking into account the applicable legislation. The processing, after the recruitment process, of the personal data of applicants selected for the position applied for on the basis of the recruitment process (i.e. employee) is described in more detail in Cactos' privacy policy concerning personnel.
9. Policies of Personal Data Protection and Data Security
Cactos follows good information management practices, a high duty of care, and effective data security measures in the processing of personal data, in addition to which the information security of systems as well as the confidentiality, integrity, and availability of personal data are ensured by appropriate technical and organizational measures.
Access to the data is granted only to persons employed by Cactos or to its authorized parties whose performance of work tasks requires the processing of personal data. The personal data is protected with personal user IDs and passwords. Cactos requires from its personnel and partners a commitment to the careful processing and confidentiality of customer data.

10. Data Subject Rights
The data subject has the rights described in this section in accordance with applicable data protection legislation. Please note that the applicability of these rights in individual cases depends on the purpose and legal basis of the processing of personal data.
If the data subject wishes to exercise their rights, the data subject must submit a request concerning the exercise of these rights by email to the address indicated in Section 2 of this Privacy Policy. As a rule, Cactos does not charge any fee for handling such a request from the data subject. However, if the requests made by the data subject are manifestly unfounded or excessive, for example if they are made repeatedly, Cactos may, in accordance with applicable data protection legislation, charge a reasonable fee based on the administrative costs incurred in handling the request, or refuse to act on the request.
10.1 Right to Access and Receive a Copy of Personal Data
The data subject has the right to obtain confirmation as to whether or not personal data concerning them are being processed and the information required under applicable data protection legislation. The data subject also has the right to obtain a copy of the personal data undergoing processing.
10.2 Right to Examination and Rectification
The data subject shall have the right to access the personal data that is stored in the register. The data subject shall have the right to request the correction of inaccurate or imprecise personal data.
10.3 Right to Erasure
The data subject has the right, in situations provided for under data protection legislation, to have its personal data erased. This right applies, for example, in situations where the data are processed in connection with direct marketing. If you exercise your right to erasure, Cactos may, however, not be able to complete the recruitment process in your regard. The purposes of processing are described in the section of this Privacy Policy concerning the purposes of processing.
10.4 Right to Restriction of Processing
The data subject may request the controller to restrict the processing of their personal data. This right applies, for example, where the accuracy of the personal data is contested, or where the original purpose of the processing is no longer applicable.
10.5 Right to Object to the Processing
The data subject has the right to object, on grounds relating to their particular situation, to the processing of their personal data where such processing is based on legitimate interest. In such a case, Cactos will cease processing the personal data unless the processing is permitted under an exception provided for in the General Data Protection Regulation.
10.6 Right to Withdraw Consent
Where the processing of personal data by Cactos is based on the data subject's explicit consent, the data subject has the right to withdraw their consent. If you withdraw the consent, Cactos may, however, not be able to complete the recruitment process in your regard.
10.7 Right to Data Portability
The data subject has the right, in situations provided for under data protection legislation, to receive the personal data concerning them, which they have provided to the controller, in a structured, commonly used, and machine-readable format, and to transmit those data to another controller where technically feasible.
10.8 Right to Lodge a Complaint with a Supervisory Authority
The data subject has the right to lodge a complaint with a supervisory authority if they consider that the processing of their personal data infringes applicable data protection regulations.
11. Changes to Privacy Policy
Cactos may update this Privacy Policy, for example, due to changes in data processing practices or applicable legislation. We recommend reviewing the contents of the Privacy Policy regularly. The most recent version of this Privacy Policy is always available on Cactos's website.
Tietosuojaseloste – Rekrytointi
1. Yleistä
Tässä tietosuojaselosteessa (”Tietosuojaseloste”) kuvataan, mitä rekisteröidyn (”sinä”, ”hakija” tai ”rekisteröity”) henkilötietoja Cactos Oy (3249847–2), Cactos Fleet Management Finland Oy (3296517–3), Cactos Energia Oy (3544975–6), Cactos Fund Management Oy (3544966–8), Cactos B.V (89387228–000055184006) sekä Cactos Netherlands B.V (89394534–000055190715) (yhdessä ”Cactos”, ”me” tai ”rekisterinpitäjä”) käsittelee rekisterinpitäjänä sekä miten ja mitä tarkoitusta varten näitä henkilötietoja käsitellään. Tietosuojaselosteessa kuvataan myös, miten henkilötietoja siirretään kolmansille tahoille ja kuinka voit käyttää henkilötietojen käsittelyyn liittyviä oikeuksiasi.
Tätä Tietosuojaselostetta sovelletaan Cactoksen rekrytointiprosessien yhteydessä kerättävien henkilötietojen käsittelyyn. Cactos noudattaa kaikessa henkilötietojen käsittelyssä soveltuvaa tietosuojalainsäädäntöä mukaan lukien tietosuoja-asetusta (EU 2016/679) ja tietosuojalakia (1050/2018). Niitä tietosuojaan liittyviä termejä, joita ei ole määritelty tässä Tietosuojaselosteessa, tulkitaan tietosuojalainsäädännön mukaisesti.

3. Rekisteröityjen ryhmät
Tässä Tietosuojaselosteessa kuvattu henkilötietojen käsittely koskee Cactokselta työtä hakeneita henkilöitä (työnhakijat) sekä Cactoksen urasivustolla tai rekrytointialustalla vierailevia henkilöitä.
4. Käsiteltävät henkilötiedot, käsittelyn tarkoitus ja oikeusperuste
Cactos käsittelee rekisterinpitäjänä hakijan tietoja, joita kerätään Cactoksen rekrytointiprosessin mahdollistamiseksi ja läpiviemiseksi. Rekrytointiprosessilla tarkoitetaan tässä Tietosuojaselosteessa prosessia, jossa Cactos rekrytoi uusia työntekijöitä, sisältäen työhakemusten läpikäynnin, haastattelut, mahdolliset soveltuvuusarvioinnit sekä rekrytoinnista viestimisen.
Alla on kuvattu tarkemmin, mitä henkilötietoja Cactos voi käsitellä osana rekrytointiprosessia sekä käsittelyn oikeusperuste:
● yksilöintitiedot (nimi, syntymäaika, osoite, puhelinnumero, sähköposti)
● osaamiseen liittyvät tiedot (osaamis-, koulutus-, työkokemus- ja tutkintotiedot)
● mahdolliset hakijan ilmoittamat suosittelijat ja näiden yhteystiedot
● muut mahdolliset hakijan työhakemuksessa, ansioluettelossa, työhaastattelussa, ja mahdollisessa soveltuvuusarvioinnissa antamat tiedot.
Henkilötietojen käsittely perustuu Cactoksen oikeutettuun etuun hakijan työhakemuksen käsittelemiseksi ja rekrytointiprosessin toteuttamiseksi sekä rekisteröidyn nimenomaiseen suostumukseen sikäli kuin suostumuksen yhteydessä on näin tarkemmin yksilöity. Tässä Tietosuojaselosteessa kuvattuun Cactoksen suorittamaan henkilötietojen käsittelyyn ei liity automatisoitua päätöksentekoa.
Sikäli kuin henkilötietojen käsittely perustuu oikeutettuun etuun, hakijalla on rekisteröitynä oikeus saada lisätietoja sovellettavasta oikeutetusta edusta Tietosuojaselosteen kohdassa 2 esitettyjen yhteystietojen kautta. Hakija on velvollinen hankkimaan tarvittavat suostumukset mahdollisten suosittelijoidensa henkilötietojen tallentamiseksi ja käsittelemiseksi tämän tietosuojaselosteen mukaisesti.
Lisäksi käyttäessäsi Cactoksen verkkosivustoa Cactos käsittelee seuraavia henkilötietojasi:
● Evästetiedot, kuten käytettävä selain, käyttöjärjestelmä, laitemalli, IP-osoite, sijaintitieto, yhteyden muodostamisaika ja yhteyden kesto (verkkosivuston evästebannerissa kuvataan tarkemmin käsiteltäviä evästetietoja);
● Tilastollista tietoa esimerkiksi verkkosivuston tai sovelluksen kävijämääristä, käyttötavoista, sijainnista, taikka muutoin käyttäytymisestä verkkosivulla tai sovelluksessa; ja
● Sivuston kautta kerättävät tiedot kuten nimi, sähköposti, puhelinnumero, yritys sekä muut mahdolliset yhteydenottolomakkeelle täyttämäsi tiedot.
Vieraillessasi Cactoksen verkkosivuilla Cactos käsittelee yllä yksilöityjä henkilötietoja verkkosivuston tarjoamiseksi, ylläpitämiseksi ja kehittämiseksi, verkkosivuston käytön tilastoimiseksi ja verkkosivuston kautta tulleiden yhteydenottopyyntöjen käsittelemiseksi. Henkilötietojen käsittely yllä yksilöityihin tarkoituksiin perustuu Cactoksen oikeutettuun etuun ja muutoin rekisteröidyn erilliseen nimenomaiseen suostumukseen. Cactoksen verkkosivuston evästebannerista voit hallita evästeiden käyttöä koskevia suostumuksia sekä saada tarkempia tietoja verkkosivustolla käytetyistä evästeistä, ja niiden keräämistä henkilötiedoista.
5. Säännönmukaiset tietolähteet
Cactos kerää henkilötietoja lähtökohtaisesti rekisteröidyltä itseltään rekrytointiprosessin yhteydessä. Cactos voi saada henkilötietoja myös rekisteröityyn nähden kolmansilta osapuolilta, kuten rekrytointiprosessiin osallistuvilta rekrytointikonsulteilta sekä osin hakijan osoittamista lähteistä kuten hakijan suosittelijoilta.
6. Tietojen käsittelijät ja muut vastaanottajat
Henkilötietoja voidaan luovuttaa rekisterinpitäjään sopimussuhteessa oleville palveluntarjoajille, rekrytointikonsulteille ja rekrytointiyhtiöille niiltä osin, kun kyseinen konsultti tai yhtiö osallistuu hakijan rekrytointiprosessiin käsittelyn tarkoituksen toteuttamiseksi.
Lisäksi Cactos voi luovuttaa henkilötietoja rekrytoinnin teknisenä toteuttajana tai muina rekrytointipalveluntarjoajina ja siten Cactoksen keräämien henkilötietojen käsittelijänä toimiville tahoille, joiden kanssa Cactos on solminut asianmukaiset sovellettavan tietosuojalainsäädännön edellyttämät sopimukset henkilötietojen käsittelystä.
Cactos voi joutua poikkeustilanteissa luovuttamaan henkilötietoja myös muille kolmansille osapuolille, mikäli voimassa oleva laki, asetus tai muu viranomaisen määräys niin vaatii.
Cactos voi myös luovuttaa henkilötietoja konserniyhtiöidensä välillä sekä mahdollisen yrityskaupan tai liiketoimintakaupan yhteydessä, jossa Cactos tai sen liiketoiminta tai näiden osa myydään tietojen vastaanottajalle.
7. Tietojen siirto EU:n tai ETA-alueen ulkopuolelle
Cactos siirtää henkilötietoja EU:n tai ETA:n ulkopuolelle, mikäli se on tarpeen henkilötietojen käsittelyn käyttötarkoitusten toteuttamiseksi tai tietojen teknisen ylläpidon vuoksi. Mikäli henkilötietoja käsitellään EU:n tai ETA:n ulkopuolella huolehtii Cactos siitä, että EU:n tietosuoja-asetuksessa asetetut tietojen siirron edellytykset täyttyvät, ja että kerättyjä tietoja siirretään vain sellaisiin kolmansiin maihin tai tahoille joiden tietosuojan tason Euroopan komissio on todennut riittäväksi (esimerkiksi EU-U.S. Data Privacy Frameworkin nojalla), tai että henkilötietojen vastaanottaja on sitoutunut Euroopan komission henkilötietojen käsittelyä koskeviin mallilausekkeisiin, sekä tarvittaessa huolehtinut riittävistä teknisistä lisäsuojatoimenpiteistä.
Mikäli kansainvälinen tiedonsiirto perustuu komission mallilausekkeisiin, sinulla on rekisteröitynä oikeus saada sovelletut mallilausekkeet nähtävillesi ottamalla yhteyttä tämän Tietosuojaselosteen kohdassa 2 mainittuun osoitteeseen.
8. Henkilötietojen säilyttämisen periaatteet
Cactos säilyttää käsittelemiään henkilötietoja vain niin kauan kuin ne ovat tarpeen niihin tarkoituksiin, joita varten henkilötietoja käsitellään.
Hakijan henkilötietoja säilytetään rekrytointiprosessin keston ajan sekä yhden (1) vuoden rekrytointiprosessin päättymisen jälkeen, ellei tietojen pidemmälle säilyttämiselle ole esimerkiksi laista tai oikeusvaateen selvittämisestä johtuvaa perustetta. Cactos arvioi tietojen säilyttämisen tarpeellisuutta säännöllisesti sovellettava lainsäädäntö huomioon ottaen.
Rekrytointiprosessin perusteella haettuun tehtävään valittujen hakijoiden (ts. työntekijä) henkilötietojen käsittelyä rekrytointiprosessin jälkeen kuvataan tarkemmin Cactoksen henkilöstöä koskevassa tietosuojaselosteessa.
9. Henkilötietojen suojaamisen ja tietoturvan periaatteet
Cactos noudattaa hyviä tiedonhallintakäytäntöjä, korkeaa huolellisuusvelvoitetta ja tehokkaita tietoturvatoimenpiteitä henkilötietojen käsittelyssä, minkä lisäksi järjestelmien tietoturvallisuus sekä henkilötietojen luottamuksellisuus, eheys ja käytettävyys varmistetaan asianmukaisin teknisin ja organisatorisin toimenpitein.
Tietoihin on käyttöoikeus vain Cactoksen palveluksessa olevilla henkilöillä tai sen valtuuttamilla toimijoilla, joiden työtehtävien suorittaminen edellyttää henkilötietojen käsittelyä. Henkilötiedot on suojattu henkilökohtaisilla käyttäjätunnuksilla ja salasanoilla. Cactos edellyttää henkilöstöltään ja yhteistyökumppaneiltaan sitoutumista asiakastietojen huolelliseen käsittelyyn ja salassapitoon.

10. Rekisteröidyn oikeudet
Rekisteröidyllä on tietosuojalainsäädännön mukaiset tässä kappaleessa kuvatut oikeudet. Huomioithan, että oikeuksien tarkempi soveltaminen kussakin yksittäistilanteessa riippuu henkilötietojen käsittelyn tarkoituksesta ja käsittelyperusteesta.
Rekisteröidyn halutessa käyttää oikeuksiaan, tulee rekisteröidyn lähettää oikeuksiaan koskevat pyynnöt sähköpostitse tämän Tietosuojaselosteen kohdassa 2 ilmoitettuun sähköpostiosoitteeseen. Pääsääntöisesti Cactos ei peri pyynnön käsittelystä maksua rekisteröidyltä. Jos rekisteröidyn pyynnöt ovat kuitenkin ilmeisen perusteettomia ja kohtuuttomia, kuten jos niitä esitetään toistuvasti, Cactos voi sovellettavan tietosuojalainsäädännön mukaisesti periä rekisteröidyltä pyynnön käsittelystä aiheutuviin hallinnollisiin kustannuksiin perustuvan kohtuullisen maksun tai kieltäytyä käsittelemästä pyyntöä.
10.1 Oikeus saada pääsy henkilötietoihin ja saada jäljennös henkilötiedoista
Rekisteröidyllä on oikeus saada vahvistus siitä, käsitelläänkö rekisteröidyn henkilötietoja, sekä tietosuojalainsäädännössä määritellyt tiedot henkilötietojen käsittelystä. Lisäksi rekisteröidyllä on oikeus saada jäljennös käsiteltävistä henkilötiedoista.
10.2 Oikeus tietojen tarkastamiseen ja oikaisemiseen
Rekisteröidyllä on oikeus tarkastaa, mitä häntä koskevia tietoja rekisteriin on tallennettu. Rekisteröidyllä on oikeus vaatia virheellisen tai epätarkan henkilötiedon korjaamista.
10.3 Oikeus tietojen poistamiseen
Rekisteröidyllä on tietosuojalainsäädännön mukaisissa tilanteissa oikeus saada häntä koskevat henkilötiedot poistettua. Oikeus toteutuu esimerkiksi tilanteissa, joissa tietoja käsitellään suoramarkkinoinnin yhteydessä. Mikäli käytät oikeuttasi tietojen poistamiseen ei Cactos kuitenkin välttämättä pysty viemään rekrytointiprosessia osaltasi loppuun. Käsittelyn tarkoituksista on kerrottu tämän Tietosuojaselosteen käyttötarkoituksia koskevassa osiossa.
10.4 Oikeus käsittelyn rajoittamiseen
Rekisteröity voi pyytää rekisterinpitäjää rajoittamaan häntä koskevien henkilötietojen käsittelyä. Tämä oikeus toteutuu esimerkiksi tilanteissa, joissa rekisteröity kiistää henkilötietojen paikkansapitävyyden tai alkuperäinen käsittelyn tarkoitus ei ole enää ajankohtainen.
10.5 Oikeus vastustaa käsittelyä
Rekisteröidyllä on oikeus vastustaa henkilötietojensa käsittelyä erityisen henkilökohtaisen tilanteen perusteella, jos käsittely perustuu oikeutettuun etuun. Tällöin Cactos lopettaa tietojen käsittelyn, paitsi jos käsittely on sallittu tietosuoja-asetuksen mukaisen poikkeuksen perusteella.
10.6 Oikeus peruuttaa suostumus
Cactoksen käsitellessä henkilötietojasi nimenomaisen suostumuksesi perusteella, sinulla on halutessasi oikeus peruuttaa antamasi suostumus. Mikäli peruutat antamasi suostumuksen ei kuitenkin Cactos välttämättä pysty viemään rekrytointiprosessia osaltasi loppuun.
10.7 Oikeus siirtää tiedot järjestelmästä toiseen
Rekisteröidyllä on tietosuojalainsäädännön mukaisissa tilanteissa oikeus saada häntä koskevat henkilötiedot, jotka hän on toimittanut rekisterinpitäjälle, jäsennellyssä, yleisesti käytetyssä ja koneellisesti luettavassa muodossa, sekä oikeus siirtää kyseiset tiedot toiselle rekisterinpitäjälle, jos se on teknisesti mahdollista.
10.8 Oikeus tehdä valitus valvontaviranomaiselle
Rekisteröidyllä on oikeus tehdä valitus valvontaviranomaiselle, jos rekisteröity katsoo, että häntä koskevien henkilötietojen käsittelyssä rikotaan soveltuvaa tietosuojasääntelyä.
11. Muutokset tietosuojaselosteeseen
